Ian Corp, attorney with the firm’s litigation and dispute resolution practice group, was quoted in a Blockworks article on the recent Coinbase-backed legal challenge to US government sanctions against Tornado Cash.
The plaintiffs filed a motion seeking to reopen Tornado Cash for all US-based citizens, arguing that the government cannot sanction the mixer since it is not a foreign “national,” “person” or group of people, but rather, a software.
“The plaintiffs’ counsel was smart to liken Tornado Cash’s code to an unincorporated entity/association, which is beyond the definition given under binding law,” said Corp.
According to the Blockworks article, the US Government, believes Tornado Cash to be a threat to economic sovereignty and a tool used by the nation’s enemies for retribution.
“Judges want to promote justice and do the right thing. When the government makes an argument that it has a compelling interest in protecting the United States from a cybercrime group in North Korea, that is hard to ignore,” he said.
