Attorney Javier J. Rodriguez secured a major victory on behalf of Sedano’s Supermarkets in a high-stakes construction contract lawsuit involving the build-out of its Hialeah store. The contractor sought approximately $770,000 in unpaid change orders and additional compensation related to project delays, but Sedano’s demonstrated that the change orders were invalid because they were not signed as required by the contract. Sedano’s also argued the contractor was seeking payment for work already included in the original scope or for work that was deficient or tied to prior rejected change orders. In addition, Sedano’s asserted its own contractual right to recover more than $130,000 in liquidated damages for extensive delays. After reviewing the evidence and testimony, Judge Mavel Ruiz ruled that the contract was clear and enforceable and that Sedano’s owed nothing beyond what was originally agreed. The decision fully validated Sedano’s position and calculations, resulting in a complete win for the regional supermarket chain.
