Agentis Secures Appellate Victory in Florida Real Estate Commission Dispute Involving Procuring Cause Doctrine

Attorneys Javier J. Rodriguez and Izabella Mojica secured an appellate victory before the Florida Third District Court of Appeal, successfully defending the summary judgment they obtained at the trial court level in a real estate commission dispute.

The appeal arose from a contested real estate commission dispute centered on Florida’s procuring cause doctrine, a fact-intensive legal standard that determines whether a broker’s efforts were the direct and primary cause of a completed transaction. Under Florida law, a broker is not automatically entitled to a commission merely for introducing parties or participating in preliminary discussions. Instead, the broker must demonstrate that its efforts set in motion an unbroken chain of events that directly resulted in the sale.

After the Agentis team carefully developed the record at the trial court level, Javier successfully argued that the undisputed facts did not satisfy this standard. The evidence showed that the transaction ultimately closed through circumstances and negotiations that were not legally attributable to the broker’s efforts. Based on that record, the trial court entered summary judgment in favor of Javier and Izabella’s client.

On appeal, the Third District conducted a de novo review of the summary judgment ruling. Javier presented oral argument before the Florida Third District Court of Appeal, addressing the application of the procuring cause doctrine and the governing summary judgment standard. The appellate court affirmed, agreeing that the record did not establish entitlement to a commission as a matter of law. The decision preserved the judgment in full and brought the dispute to a successful and final resolution for the client. The court also granted the Agentis team’s motion for attorneys’ fees, further reinforcing the strength of the client’s position.
